Educate and Inform: We educate the awarding agencies on effective compliance on the vast number of laws that are required to “level the playing field.” At NCECI we seek to assure that violations are corrected and not repeated. Resolve Compliance Issues: Legal processes may be used to obtain orders requiring the cessation of labor and contracting law violations and the correction of related impacts, such as through pre-qualification requirements, safety improvements, or project labor agreements. Uphold Standards through Enforcement: Violating labor or public works laws carries an obligation to society and impacts the construction community or the public. Penalties serve a distinct purpose and may include corrective actions, fines, or imprisonment. Set Clear Expectations NCECI’s enforcement helps set behavioral standards for the electrical contracting community and clarify consequences for noncompliance. When NCECI prompts the state to issue legal interpretations, these serve as valuable precedents and guidance. What if the filing deadline to file a public works complaint has passed? If 18 months have passed since the project’s completion, the Labor Commissioner’s Office cannot investigate the employer or issue an assessment. However, NCECI will assist you in filing a civil lawsuit in superior court if you would like and the evidence is solid. We must file a civil lawsuit for statutory violations of prevailing wage, minimum wage, overtime, illegal deductions from pay, or unpaid reimbursements within three years.
